Dog Owner Appealing Decision for a Second Time

The owner of a dog Vincennes City officials labeled as dangerous and ordered put down, is appealing the decision for a second time. 

 

The Vincennes Sun Commercial says that a lack of an appeals process in a Vincennes City Ordinance is creating problems for the City’s Board of Works.

The situation began when a dog owned by Courtney Ivers bit and injured a male visitor to her home.  The visitor injuries required surgery.    The newspaper reports that police were called to the home as a result of the attack and the dog was quarantined at the Vincennes Animal Shelter.   Based on the severity of the bite and other factors, Vincennes Animal Shelter Director Laura Arial recommended the dog be euthanized.   Ivers appealed that decision.

Board of Works member pointed to details from police interviews after the incident, including Ivers allegedly warning officers about the dog’s ill temperament in denying Ivers’s appeal of Arial’s recommendation.

Ivers says the dog had never been aggressive before and  the incident happened because the dog was startled by her male visitor

Ivers originally appealed Arial’s decision to the Vincennes Board of Works.  She is now appealing the Board initial decision.   Lawyers say that without a specified appeal process and time line in the Vincennes ordinance.  The appeals could take some time.
