Donnelly added 11 months is too long for the Court to operate shorthanded. And he notes nothing in the Constitution says a president loses his appointment power in his final year in office.

Republican Senator Dan Coats senators should wait till a new president takes office in January.

Coats is retiring and won’t be around for a confirmation vote next year, but he says even if Hillary Clinton or Bernie Sanders wins the presidency in November, that shouldn’t guarantee a free pass for their nominee.
