Woman sues over not being able to provide a urine test

A southwestern Indiana woman is suing a township trustee’s office for denying her government assistance because her disabilities prevented her from providing a urine sample for a required drug-screening test.

The American Civil Liberties Union of Indiana filed the federal lawsuit Thursday on behalf of Mary Neale, an impoverished Posey County resident stricken with arthritis, back pain and obesity. It names the Black Township Trustee’s office and Trustee Lindsay Suits.

The suit contends the trustee’s office denied Neale financial assistance last year because her disabilities prevented her from being able to provide a urine sample using a cup provided by the office.

The complaint says the screening violates the Fourth Amendment’s protections against unreasonable government searches.
